TERMS & CONDITIONS
Effective Date: August 24, 2026
Welcome to Swiftlyst Logistics. These Terms & Conditions govern the use of our shipping, freight, delivery, warehousing, and assisted shopping services.
By requesting or using any service provided by Swiftlyst Logistics, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
1. ACCEPTANCE OF TERMS
By placing an order, submitting a package, requesting a delivery, using our assisted shopping service, making a payment, or otherwise using Swiftlyst Logistics, you agree to these Terms & Conditions.
These Terms apply to all customers unless a separate written agreement has been made with Swiftlyst Logistics.
If you do not agree with these Terms, please do not use our services.
2. OUR SERVICES
Swiftlyst Logistics provides logistics and shipping services, including:
USA-to-Jamaica shipping
Air freight
Sea freight
Assisted online shopping
Assisted online payment services, where available
Package receiving and warehousing
Package handling
Pickup services
Drop-off services
Mobile delivery
Other logistics services offered by Swiftlyst Logistics
Services may vary depending on the type, size, weight, destination, contents, and requirements of a shipment.
Swiftlyst Logistics reserves the right to modify, suspend, or discontinue a service where reasonably necessary.
3. SHIPPING SCHEDULES
Swiftlyst Logistics generally ships approximately three (3) times per week.
Shipping schedules and estimated arrival times are provided for convenience and are not guaranteed delivery dates.
Shipments may experience delays due to:
Customs processing
Customs inspections
Airline or shipping-line schedules
Weather
Port or airport delays
Holidays
Government regulations
Security inspections
Incorrect or incomplete documentation
Vendor delays
Third-party courier delays
Other circumstances outside our reasonable control
Customers should not rely solely on an estimated arrival date when making time-sensitive purchases or arrangements.
4. SERVICE AREA
Swiftlyst Logistics currently provides direct service to:
Guy’s Hill
Delivery to other locations may be available through third-party courier or delivery providers.
Additional delivery charges may apply and will be communicated to the customer where applicable.
Customers are responsible for providing an accurate name, telephone number, and delivery address.
5. CUSTOMER RESPONSIBILITIES
Customers are responsible for providing accurate and complete information for every shipment or order.
This may include:
Full name
Telephone number
Delivery address
Accurate item description
Purchase invoice or receipt
Correct item value
Customs information
Required permits or documentation
Any other information reasonably required to process the shipment
Customers must not provide false, misleading, or incomplete information.
Swiftlyst Logistics will not be responsible for delays, additional charges, customs issues, or delivery problems caused by inaccurate or incomplete information provided by the customer.
Jamaica Customs requires importers to provide accurate information and, where requested, authentic receipts, invoices, proof of value, and applicable permits or certificates. (Jamaica Customs Agency)
6. CUSTOMS, DUTIES & GOVERNMENT FEES
International shipments may be subject to customs duties, taxes, inspections, permits, storage fees, and other government charges.
The customer is responsible for applicable customs duties, taxes, permits, government fees, customs storage charges, and other charges associated with the importation and clearance of their shipment.
Swiftlyst Logistics does not guarantee that a shipment will clear customs without inspection, delay, additional charges, or documentation requirements.
Customers are responsible for ensuring that their items are legally permitted to enter Jamaica and that all required permits or certificates are obtained where applicable.
Jamaica Customs advises that restricted items may require permits and that its restricted/prohibited list is not exhaustive and may change. (Jamaica Customs Agency)
7. PROHIBITED & RESTRICTED ITEMS
Customers are responsible for ensuring that all items shipped through Swiftlyst Logistics comply with applicable laws and regulations.
Prohibited or restricted items may include, but are not limited to:
Illegal drugs or controlled substances
Firearms and ammunition
Weapons or prohibited weapon components
Explosives
Flammable or hazardous materials
Counterfeit goods
Prohibited obscene materials
Perishable foods
Live animals
Cash
Cheques
Negotiable instruments
Items requiring permits that have not been properly authorized
Any item prohibited or restricted by Jamaican law, customs authorities, airlines, shipping lines, or other applicable regulations
This list is not exhaustive.
Swiftlyst Logistics reserves the right to refuse, hold, return, surrender, or otherwise deal with prohibited or restricted items where necessary or required by law.
Where an item is seized, confiscated, detained, destroyed, or returned by customs or another authority because of its contents, declaration, documentation, or legal status, the customer may remain responsible for applicable charges, penalties, duties, and other costs to the extent permitted by law.
Jamaica Customs confirms that certain restricted goods require permits and that prohibited/restricted lists can be updated by the Government. (Jamaica Customs Agency)
8. PACKAGING & FRAGILE ITEMS
Customers and vendors are responsible for ensuring that goods are appropriately packaged for transportation.
Swiftlyst Logistics is not responsible for damage resulting from inadequate, defective, or improper packaging supplied by a vendor, sender, or customer.
Fragile items such as:
Glass
Electronics
Cosmetics
Liquids
Ceramics
Breakable goods
may carry an increased risk of damage during transportation.
Customers acknowledge that fragile items require appropriate packaging and handling.
Additional protective packaging or repackaging may be available at an additional cost where applicable.
9. LOSS, DAMAGE, DELAYS & LIABILITY
Swiftlyst Logistics will exercise reasonable care when handling packages while they are in our possession.
However, to the extent permitted by applicable law, Swiftlyst Logistics will not be responsible for loss, damage, delay, or additional costs caused by circumstances outside our reasonable control.
These circumstances may include:
Vendor errors
Incorrect information supplied by the customer
Incorrect delivery information
Packages lost before reaching our warehouse
Airline or shipping-line delays
Third-party courier or delivery errors
Customs inspections or actions
Government restrictions
Weather or natural disasters
Strikes or transportation disruptions
Other circumstances beyond our reasonable control
Once a shipment has been transferred to a third-party carrier, courier, delivery partner, customs authority, airline, or shipping line, the terms and limitations of that third party may also apply.
Nothing in these Terms is intended to exclude or limit any responsibility that cannot legally be excluded or limited.
10. ASSISTED ONLINE SHOPPING
Where Swiftlyst Logistics assists a customer with purchasing items online:
Full payment must be received before the purchase is made.
Customers must confirm the item, size, color, quantity, price, and other relevant details before purchase.
Customers are responsible for reviewing and approving the order before it is placed.
Once an order has been placed, cancellation may not be possible.
Payments may become non-refundable once the purchase or requested service has been completed, subject to applicable law.
Swiftlyst Logistics is not responsible for vendor delays, stock shortages, vendor errors, incorrect items supplied by the vendor, sizing issues, manufacturer defects, or vendor cancellations.
Returns, exchanges, warranties, and product-related refunds may be subject to the original vendor’s policies.
11. PAYMENTS
Swiftlyst Logistics accepts the following payment methods:
Bank transfer
Cash
Unless otherwise agreed, payment must be made in full before the applicable service or shipment is processed.
Customers are responsible for ensuring that payments are made correctly and within the required timeframe.
Additional charges may apply for services requested outside the original arrangement.
12. INVOICES
Customers are responsible for reviewing their invoice before making payment.
If a customer believes an invoice contains an error, they should contact Swiftlyst Logistics promptly.
Outstanding balances may delay shipment release, delivery, pickup, or other services.
Customers may be required to settle all outstanding charges before a package is released.
13. REFUNDS & CANCELLATIONS
Cancellation requests should be made at least two (2) hours before the scheduled service, where applicable.
Cancellation fees may apply where costs have already been incurred.
Once a service has been performed, a shipment has been processed, an item has been purchased, or a shipment has been transferred to a third party, cancellation may no longer be possible.
Refunds will be considered based on the nature and stage of the transaction and applicable law.
Swiftlyst Logistics does not provide refunds simply because a customer changes their mind after a service has already been performed or an order has been placed, except where required by applicable law or the applicable vendor’s refund policy.
Any refund policy communicated for a particular service will form part of the terms applicable to that transaction.
The Fair Trading Commission advises that refund policies should clearly communicate matters such as the claim period, proof of purchase, refund method, and any applicable deductions. (Fair Trading Commission)
14. CLAIMS & COMPLAINTS
Customers should report any shipment issue as soon as possible.
Formal claims relating to damage, shortage, or other shipment issues must be submitted in writing within forty-eight (48) hours of receiving the package or being notified that the package has been received, unless a longer period is required by applicable law.
Claims may require:
Invoice or receipt
Tracking information
Photographs of the package
Photographs of damaged items
Proof of payment
Other supporting documentation
WhatsApp may be used for general customer communication and support. However, a WhatsApp conversation will not automatically constitute a formal claim unless Swiftlyst Logistics confirms that it has been recorded as such.
15. STORAGE & UNCOLLECTED PACKAGES
Customers will be notified when packages are ready for collection or delivery.
Customers should collect their packages within fourteen (14) days of notification unless another arrangement has been agreed.
Packages remaining uncollected after fourteen (14) days may incur a storage fee of:
J$200 per package
Customers remain responsible for all outstanding shipping, delivery, storage, customs, and other applicable charges.
Where a package remains uncollected for an extended period, Swiftlyst Logistics may, after reasonable notice and subject to applicable law, return, donate, dispose of, or sell the package to recover outstanding costs where legally permitted.
16. DELIVERY
Customers are responsible for ensuring that someone is available to receive a delivery when required.
If a delivery cannot be completed because:
The customer is unavailable
The address is incorrect
The customer cannot be contacted
The customer refuses the package
Additional delivery charges have not been paid
an additional delivery attempt or fee may apply.
Swiftlyst Logistics may require identification or other reasonable confirmation before releasing a package.
17. THIRD-PARTY SERVICE PROVIDERS
Swiftlyst Logistics may use third-party carriers, couriers, shipping lines, airlines, vendors, warehouses, payment providers, or other service providers.
Third-party providers may have their own policies, fees, restrictions, and liability limitations.
Swiftlyst Logistics is not responsible for matters caused solely by a third-party provider and outside our reasonable control.
18. REFUSAL OF SERVICE
Swiftlyst Logistics reserves the right to refuse or discontinue service where reasonably necessary, including where:
Required information has not been provided
Payment has not been received
The shipment contains prohibited or restricted items
The customer provides false or misleading information
The shipment presents a safety or legal concern
The requested service is unavailable
Processing the shipment would violate applicable laws or regulations
19. CUSTOMER COMMUNICATION
Customers are responsible for providing accurate and active contact information.
Customers should promptly respond to requests for:
Payment
Customs information
Documentation
Delivery instructions
Identification
Other information required to complete their shipment or order
Failure to respond may result in delays or additional charges.
20. FORCE MAJEURE
Swiftlyst Logistics will not be responsible for delays or inability to perform services caused by circumstances beyond our reasonable control.
These may include:
Severe weather
Natural disasters
Fire
Flood
War
Civil unrest
Government action
Customs restrictions
Strikes
Transportation disruptions
Port or airport closures
Power outages
Telecommunications failures
Other circumstances beyond our reasonable control
We will make reasonable efforts to resume services when circumstances permit.
21. PRIVACY & CUSTOMER INFORMATION
Swiftlyst Logistics may collect and use customer information reasonably necessary to provide shipping, delivery, purchasing, payment, customs, and customer-support services.
Customer information may be shared with carriers, customs authorities, vendors, delivery partners, payment providers, or other service providers where reasonably necessary to complete the requested service or comply with applicable law.
Swiftlyst Logistics will take reasonable steps to protect customer information.
22. CHANGES TO THESE TERMS
Swiftlyst Logistics reserves the right to update these Terms & Conditions when necessary.
Updated Terms may be posted on our website or otherwise communicated to customers.
Changes will generally apply to services requested after the updated Terms become effective.
23. GOVERNING LAW
These Terms & Conditions are intended to be governed by the laws of Jamaica, subject to any applicable consumer protections and other mandatory legal requirements.
Customers and Swiftlyst Logistics agree to make reasonable efforts to resolve disputes directly before pursuing other available remedies.
Nothing in these Terms prevents a customer from exercising any rights available under applicable Jamaican law.
24. ENTIRE AGREEMENT
These Terms & Conditions, together with any applicable invoice, quotation, order confirmation, service information, or written agreement, constitute the agreement between Swiftlyst Logistics and the customer regarding the relevant service.
Where a specific written agreement conflicts with these Terms, the specific written agreement may apply to that transaction.
25. CUSTOMER ACKNOWLEDGEMENT
By checking the acceptance box, submitting an order, making payment, or using Swiftlyst Logistics services, the customer confirms that:
I have read and understood the Swiftlyst Logistics Terms & Conditions.
I have provided accurate information.
I understand that shipping and delivery times are estimates and may be affected by circumstances outside Swiftlyst Logistics’ control.
I understand that customs duties, taxes, permits, and applicable government charges may apply.
I understand that prohibited and restricted items are subject to applicable laws and regulations.
I understand the claims and storage policies.
I understand the payment, cancellation, and refund policies.
I agree to comply with these Terms & Conditions.
